Information about imaging procedures, preparation instructions, and other clinical topics presented on the Website is general in nature and may not apply to your specific situation. Your treating physician and our imaging staff will provide instructions specific to your care.

5. Patient Information and HIPAA

Any Protected Health Information (“PHI”) you provide to us‚ including through patient portals, intake forms, or in-person at our facilities, is governed by our Notice of Privacy Practices and the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”). Do not send PHI through unencrypted email or general contact forms.  Use the patient portal or contact one of our facilities directly to share sensitive health information.

6. Accounts and Patient Portal

If the Website offers an account or patient portal, you agree to:

– Provide accurate, current, and complete information when registering
– Maintain the confidentiality of your username and password
– Promptly notify us of any unauthorized access or use of your account
– Accept responsibility for all activity that occurs under your account

11. Appointment Scheduling, Cancellation, and Insurance

Appointment requests submitted through the Website are requests only and are not confirmed until you receive confirmation from our scheduling team. Specific scheduling, cancellation, and no-show policies are provided at the facility where you receive services.

While we may verify insurance benefits as a courtesy, coverage is determined by your insurance carrier, and you remain responsible for any amounts not covered by your insurance. Please contact your insurance carrier directly to confirm coverage before your appointment.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE WEBSITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

Nothing in these Terms limits or excludes any liability that cannot lawfully be limited or excluded, including liability for gross negligence, willful misconduct, or where applicable, bodily injury caused by negligence in the provision of medical services. Liability for medical services is governed by the agreements and consents you sign at the facility where you receive care, and by applicable law.

You agree to indemnify, defend, and hold harmless MRI Associates and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with: (a) your access to or use of the Website; (b) your violation of these Terms; or (c) your violation of any rights of another person or entity.

15. Termination

We may suspend or terminate your access to the Website at any time, with or without notice, for any reason, including if we believe you have violated these Terms. Upon termination, the provisions of these Terms that by their nature should survive termination will survive, including Sections 5 (Patient Information), 8 (Intellectual Property), 9 (User Submissions), 12 (Disclaimers), 13 (Limitation of Liability), 14 (Indemnification), 17 (Governing Law), and 18 (Dispute Resolution).

17. Governing Law and Venue

These Terms and any dispute arising out of or relating to them or the Website are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. You agree that any action arising out of or relating to these Terms or the Website will be brought exclusively in the state or federal courts located in Pinellas county, Florida, and you consent to the personal jurisdiction of those courts.

– Entire Agreement.  These Terms, together with the Privacy Policy and any other documents expressly referenced, constitute the entire agreement between you and MRI Associates regarding the Website and supersede any prior agreements on that subject.
– Severability. If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
– No Waiver. Our failure to enforce any provision of these Terms will not be deemed a waiver of that provision.
– Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
– No Third-Party Beneficiaries. These Terms do not create any rights in any third party.
– Headings. Section headings are for convenience only and have no legal effect.
